I. Area of application and Subject of Change
(1)HOME IS WHERE YOUR HEART IS. provides all deliverable and performance to his contractual partner (herein after called customer) exclusively based on these terms and conditions. With this information the contractual partner accepts the contract with HOME IS WHERE YOUR HEART IS..


II. Contract Conclusion
(1) A contract becomes valid with an order of the customer via online order form at homeiswhereyourheartis.de, and confirmation of HOME IS WHERE YOUR HEART IS. via email. The confirmation is used as a form of information. With the order, the contractual partner obliges that he wants to buy the goods on order. HOME IS WHERE YOUR HEART IS. accepts the order with sending out or delivering the offer.

IV. Delivery and Shipping
(1) Unless otherwise expressly agreed, the delivery will occur to the address that is indicated by the contractual partner.

(2) The delivery occurs after the receipt of a payment (prepayment) within 3-5 working days (inside of Germany).

(3) Delay of delivery due to act of God or unforseeable event that complicates the service provision or makes it impossible (stoppage, lock out, official order), is not represented by HOME IS WHERE YOUR HEART IS.

(4) As far as the delivery is not possible, although the delivery date was announced within a reasonable delay, the contractual partner has to bear the costs for the unsuccessful delivery.


V. Term of payment and Discount
(1) All prices are stated in EURO and are calculated without VAT according to § 19 UStG (German sales tax law), plus shipping costs..

(2) Unless otherwise agreed, delivery occurs against prepayment or paypal.

(3) Shipping costs in Germany are 4,50 EUR per order. If you order via insured parcel an additional fee of 3,00 EUR incures. Orders via paypal have an additional fee of 0,50 EUR per order. For shipping overseas the prize varies according to the address for dispatch. For orders of more than 100,00 EUR the order is free of shipping costs (Only in Germany).

(4) The invoicing amount stated by HOME IS WHERE YOUR HEART IS. will be transfered by the contractual partner via paypal or to the following bank account

(5) Special conditions or discounts will be shown seperately and are limited.


VI. Right of revocation and return § 355 BGB (German Law) - Only Germany
(1) (1) You may declare the revocation of your contractual statement in text form (e.g. letter, email) or by returning the merchandise within a month. The revocation period commences the day following the receipt of merchandise and this revocation instruction in text form. The time-limit shall be deemed to be observed by the timely dispatch of the declaration of revocation or the return shipment. The revocation is to be addressed to:

Consequences of revocation
In case of a valid revocation, all mutually received performances as well as emoluments taken (e.g. interest), if applicable, are to be restituted by either side. If you are unable or partially unable to restitute the merchandise to us or can only restitute it in a deteriorated condition,then you have to insofar compensate for its value where applicable. This does not apply if the deterioration is exclusively due to examining the merchandise – as for instance in a retail store – or putting the merchandise to its intended use. Things that can be shipped by parcel are to be returned on our risk. Things that cannot be shipped by parcel will be picked up. You are obliged to bear the costs of the return shipment, if the merchandise delivered corresponds to the merchandise ordered, and if the price of the merchandise to be sent back does not exceed an amount of 40 EUR or if, where the price is higher, you have at the date of the revocation not yet rendered consideration or given a part payment. In all other cases, the return shipment for you is free of charge. All reimbursement obligations must be fulfilled within 30 days of the declaration of revocation. The deadline starts with the dispatch of the customer of the cancellation request or the item in question; for HOME IS WHERE YOUR HEART IS. it starts with the recipience. The offer has to be unworn and in the condition as supplied to customer!

VII. Reservation of proprietary rights
(1) The goods, as contracted remain the property of HOME IS WHERE YOUR HEART IS. until full payment has been effected.


VIII. Guarantee and Liability
(1) HOME IS WHERE YOUR HEART IS. accepts no liability for damage because of incorrect use of the HOME IS WHERE YOUR HEART IS. goods.

(2) In case of defective condition of the goods at the moment of transfer of perils, the defect will be eliminated and HIWYHI makes sure to replace the defect good.
